Entry Method 2: How to Enter (AUS only, excluding SA and ACT)

b) log into their account and purchase a membership package (“Participating Package”). The number of entries are dependent on the Participating Package purchased (see details below).
Entries will be automatically recorded upon purchase.
Participating Packages available for entry into the Promotion are listed below:

Membership Bonus Entries:

· If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. · If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
· The only warranty given by the Promoter with respect to the vehicle is that it is roadworthy when given to the winner. No extended warranty is given.

The winner of the redraw will be notified by email, phone and SMS within seven (7) days of the redraw. - The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
- The Promotion commences on the Start Date and ends on the End Date (“Promotional Period”). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
- Valid and eligible entries during the Promotional Period will be accepted.
- All reasonable attempts will be made to contact the winner.
- If the winner chooses not to take their prize (or is unable to), or does not take or claim a prize within a reasonable time, as specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
- Where entry is allowed by purchase or subscription, the cost of the product or service is no greater than the cost would be without the opportunity to participate in the Promotion.
- The value of the prize is accurate and based upon the recommended retail value of the prize (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize after that date.
- No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
- If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.
- No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
- The prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
- Entrants’ personal information will be collected by the Promoter. Personal information will be stored on the Promoter’s database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter will handle personal information in accordance with its privacy policy which is located at https://www.sadekracing.com.au/privacy-policy/. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
- For the purposes of public statements and advertisements, the Promoter may only publish the winner’s surname, initial and State/Territory/Country or postcode of residence.
- The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving the prize.
- If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry in the event of any inconsistency. To the extent permitted by law the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
- Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Consumer Guarantees Act 1993 (NZ) and/or Fair Trading Act 1986 (NZ) and the Competition and Consumer Act 2010 (Cth).
- If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
- The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant’s details (including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter’s discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
- The winner will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
- The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

This page outlines the Terms of access to and use of the website at http://www.sadekracing.com.au (Site) and the purchase of goods and services over the Site.
1. Interpretation
In these terms and conditions:
(a) a reference to a person includes any other legal entity and vice versa;
(b) words importing the singular number include the plural number and vice versa;
(c) a reference to a party includes the party’s heirs, executors, successors and permitted assigns;
(d) headings are for reference purposes only;
(e) where any word or phrase is given a defined meaning any other part of speech or other grammatical form concerning the word or phrase has a corresponding meaning;

By agreeing to the Terms, you are entering into an agreement with us, including our successors, assignees and related bodies corporate.
(c) If you disagree with any aspect of the Terms you should immediately cease all use of, and access to, the Site.
(d) By accessing the Site and utilising our services, you warrant and represent that:
(i) you have read and agree to be bound by the Terms;
(ii) you are over the age of 18;
(iii) you are located in Australia or New Zealand; and

(b) We do not guarantee or warrant the Site will be uninterrupted, without delay, error-free, omission-free or free of viruses. Accordingly, we are not liable for any loss suffered as a result of any such viruses or defects.
(c) All Content is provided “as is” without warranties of any kind, express or implied, including as to accuracy, timeliness and completeness.
(d) Subject to your rights under the Australian Consumer Law and clause 6 below, and to the maximum extent permitted by law, Sadek, its directors, officers, agents or employees:

(ii) do not warrant or guarantee that the Site will be completely accurate or continuous at all times. The site is provided on an “as is” and “as available” basis. The information contained on the site is general and may not be suitable for your particular needs;
(iii) do not accept any responsibility to maintain the material and services made available on the Site or to supply any corrections, updates, or releases in connection with the Site. Any material on the Site is subject to change without notice;
(iv) exclude all other terms, conditions, guarantees and warranties, whether express or implied, by statute, trade or otherwise; and
(v) exclude all liability to you for loss or damage of any kind (however caused, including by negligence) arising from or relating in any way to the materials on this Site and/or your use of this Site.
6. Indemnification
Without limiting any other provision of these Terms, our total liability to you, under any circumstances, will not exceed the total amount you have paid to us. 7. Orders & Payment Terms
(a) Payments for orders can be made through a third party payment processor on the Site.
(b) All prices on the Site are in Australian dollars and are inclusive of GST, unless otherwise stated.
(c) Orders will not be dispatched until funds have cleared into our account.
(d) All products advertised on the Site are subject to availability.
(e) The price payable for any products or services is the price specified on the Site at the time of placing the order. Prices displayed are subject to change at any time.
(f) Any order placed via the Site or otherwise is an offer by you to purchase a particular product for the price specified at the time you place your order. You acknowledge by placing an order, you are agreeing to pay for and accept delivery of the product(s) ordered.
8. Delivery
(a) Any orders sent out by courier are subject to postage and packaging costs, as advised on the Site. We are not liable for any orders that go missing due to incorrect delivery information provided by you.
(b) Risk of loss and title for the product(s) pass to you upon dispatch from our warehouse to the delivery carrier.
(c) We are not responsible for any delay in delivery of any products caused by, or in any way connected with, any other cause beyond our reasonable control (including but not limited to shortfall of supplies, strikes, industrial disputes).
9. Returns and Refunds
(a) You must notify us within five (5) business days of delivery of any shortfall, damaged or incorrect orders.
(b) If a product received by you is damaged, faulty or not fit for purpose, promptly contact us on [email protected] to provide details on the fault or damage or reason why you feel the product is not fit for purpose. Nothing in the Terms reduces or limits your rights under the Australian Consumer Law. A refund will not be provided by us if the fault or damage to the product has been caused by misuse (by either you or a third party) or if the product has been modified or tampered with in any way by you or a third party. Furthermore, a refund shall not be provided if we believe that the product is, in fact, fit for purpose (i.e. the product can, in fact, be used for its intended purpose).
(c) We do not replace or refund for goods or services as a result of a change of mind, so please choose carefully.
(d) You acknowledge that, despite our reasonable precautions, products may be listed at an incorrect price or with incorrect information due to typographical error or like oversight. In these circumstances, we reserve the right to cancel the order, notwithstanding that your order has been confirmed and your credit card has been charged. If a cancellation of this nature occurs after you have been charged for the purchase, we will issue a credit to your account for the amount in question.
10. Termination
We may terminate your access to this Site at any time without reason or notice. The Terms will survive any such termination.
11. Governing Law
The Terms are governed by the laws in force in the State of New South Wales, Australia and you hereby agree to submit to the exclusive jurisdiction of the courts of New South Wales.

13. General
(a) We do not accept any liability for any failure to comply with the Terms where the failure is due to circumstances beyond our reasonable control.
(b) If we waive any rights available to us under the Terms on one occasion, this does not mean that those rights will automatically be waived on any other occasion.
(c) If any of the Terms are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will nevertheless continue in full force.
(d) The Terms, and any rights and licences granted hereunder, may not be transferred or assigned by you, but may be assigned by us for reasonable business purposes without restriction.
